Terms of Service

These Terms apply to the PoolChem Tracker iOS app. The website is governed by a separate Terms of Service.

1. Acceptance of Terms

By accessing or using PoolChem Tracker ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App. Continued use of the App after any updates to these Terms constitutes acceptance of the revised Terms.

2. Eligibility

The App is intended for use by individuals who are at least 18 years of age. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the App.

3. Description of the Service

PoolChem Tracker is a pool chemistry tracking and calculation tool designed for residential pool owners. The App may assist with tracking and estimating common pool chemistry parameters, including but not limited to:

• Free Chlorine
• pH
• Total Alkalinity
• Calcium Hardness
• Cyanuric Acid (CYA / Stabilizer)
• Salt levels
• Langelier Saturation Index (LSI)

The App is intended for personal, non-commercial residential use only and is not designed for professional or commercial pool management. We may modify, suspend, or discontinue any part of the App at any time, with or without notice.

4. Important Safety and Health Disclaimer

By using the App, you acknowledge and agree that:

• All chemical recommendations are estimates based on standard formulas and may not reflect actual pool conditions.
• Actual results may vary based on water source, weather, equipment, and other conditions.
• Improper handling of pool chemicals can result in serious injury, property damage, or death.
• You are solely responsible for any chemicals you add to your pool and how they are handled, stored, and applied.
• You must always follow manufacturer instructions, safety labels, and applicable laws and regulations.
• You should retest water after any chemical adjustment before adding additional chemicals.
• You should consult a qualified pool professional for persistent or complex issues.

The App provides informational estimates only and should not be relied upon as the sole basis for chemical treatment decisions.

Industry Standards

The App may reference commonly used industry guidelines, including standards such as ANSI/APSP/ICC-11 (2019) and related updates where applicable. However, these references may not reflect current regulations in your jurisdiction. You are solely responsible for ensuring compliance with all applicable laws and safety requirements.

5. Accuracy of Information and Warranty Disclaimer

While we strive to provide accurate calculations and information, all content in the App is provided for general informational purposes only.

The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of accuracy, reliability, completeness, merchantability, or fitness for a particular purpose.

We do not guarantee that any recommendation or calculation will produce a specific result or chemical balance.

6. Data Storage

All data you enter into the App (including readings, settings, inventory, and notes) is stored locally on your device. We do not collect, transmit, or store your pool data on any external servers.

Because your data is stored locally:

• Clearing app or device data may permanently delete your information.
• Switching devices may require restoring from your own backups.
• Data loss may occur due to device issues, updates, or user actions.

You are solely responsible for maintaining backups of your data using export features or device backup tools. We cannot recover lost data.

7. In-App Purchases

The App offers optional in-app purchases ("Pro" features) processed through the Apple App Store. All purchases are processed by Apple, and we do not receive your payment card information.

By making a purchase, you agree that:

• Purchases are subject to Apple's payment and refund policies.
• Refunds are only available where required by applicable law or provided by Apple.
• Refund requests must be handled through Apple (e.g., reportaproblem.apple.com).
• Purchases are tied to your Apple ID and can be restored on compatible devices using the "Restore Purchases" feature.
• Prices may vary by region and are subject to change, but changes will not affect completed purchases.
• Purchased features will remain accessible as long as they are supported by the App.

We reserve the right to modify or add features over time. Existing purchased features will remain accessible where reasonably possible.

8. Intellectual Property

All content, features, design, code, calculations, and user interface elements of the App are owned by or licensed to PoolChem Tracker and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the App without prior written permission.

You retain ownership of any data you enter into the App.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Use the App for commercial or professional pool management services
• Reverse engineer, decompile, or attempt to extract source code from the App
• Interfere with or disrupt the operation or integrity of the App
• Copy, distribute, resell, or exploit the App without authorization
• Use the App in any manner that could harm others or create liability

10. Limitation of Liability

To the maximum extent permitted by law, PoolChem Tracker and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, financial loss, loss of data, or chemical misuse or improper dosing outcomes, arising out of or related to your use of or inability to use the App.

Your use of the App is at your own risk. In all cases, our total liability shall not exceed the amount you paid for the App or any in-app purchases.

11. Indemnification

You agree to indemnify and hold harmless PoolChem Tracker and its owners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your handling or use of pool chemicals
• Your violation of these Terms
• Your violation of applicable laws or regulations

12. Termination

We may suspend or terminate access to the App in cases of violation of these Terms or if necessary for security, legal, or operational reasons.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms. You are responsible for reviewing these Terms periodically.

14. Governing Law

These Terms are governed by the laws of the State of California, unless otherwise required by applicable law.

15. Entire Agreement

These Terms constitute the entire agreement between you and PoolChem Tracker regarding use of the App and supersede any prior agreements or understandings.
